Chapter 1

GENERAL PROVISIONS

ARTICLE I

IN GENERAL

Sec. 1-1.  Contents of Codes.

        This Code contains all ordinances of a general and permanent nature of the City of St. James, Missouri and includes ordinances dealing with municipal administration, municipal elections, building and property regulation, business and occupations, health and sanitation, public order, streets and public places, utilities, and public buildings and grounds. 

        (a)   Ordinances hereafter adopted which are not of a general or permanent nature shall be numbered consecutively, authenticated, published and recorded in the book of ordinances, but shall not be prepared for insertion in this Code, nor be deemed a part hereof.

        (b)   Ordinances which are of a general or permanent nature shall be prepared for insertion in this Code and be deemed a part hereof.  (1977 Code)

Sec. 1-2.  Citation of Code.

        This Code may be known and cited as the "St. James,Missouri, City Code."  (1977 Code)

Sec. 1-3.  City seal.

        The city seal heretofore used by the City ofSt. James shall be the seal of the city until changed by the city council, and shall be attached to all ordinances, resolutions and orders passed by the city council, and to the authentication of all official acts of the mayor and the city clerk.  (Ord. 56, §1.)

Sec. 1-4.  Official copy.

        The official copy of this Code, bearing the signature of the mayor and attestation of the city clerk as to its adoption shall be kept on file in the office of the city clerk.  A copy of this Code shall be kept in the city clerk's office available for public inspection.  (1977 Code)

Sec. 1-5.  Altering Code.

        It shall be unlawful for any person to change or amend by additions or deletions any part or portion of this Code, or to insert or delete pages, or portions thereof, or to alter or tamper with such official copy of the Code in any manner whatsoever which will cause the law of the city to be misrepresented thereby.  Any person, firm or corporation violating this Section shall be punished as provided in Sections 1-13, 1-14, 1-15 of this Code. Sec. 1-6.  Numbering.

        Each section number of this Code shall consist of two parts separated by a hyphen; the figure before the hyphen referring to the chapter number, and the figure after the hyphen referring to the position of the section in the chapter.

Sec. 1-7.  Amendments.

        All amendments to this Code, duly passed by the city council, shall be prepared by the city clerk for insertion in this code.  (1977 Code)

Sec. 1-8.  Headings.

        The headings of the chapters and sections of this Code are intended as guides and not as part of this Code for purposes of interpretation or construction.  (1977 Code)

Sec. 1-9.  Continuation of prior ordinances.

        The provisions appearing in this Code, so far as they are in substance the same as those of ordinances existing at the time of the adoption of this Code, shall be considered as a continuation thereof and not as new enactments.  (1977 Code)

Sec. 1-10.  Repeal of ordinances not to affect liabilities.

        Whenever any ordinance or part of an ordinance shall be repealed or modified, either expressly or by implication, by a subsequent ordinance, the ordinance or part of an ordinance thus repealed or modified shall continue in force until the subsequent ordinance repealing or modifying the prior ordinance shall go into effect unless therein otherwise expressly provided; but no suit, prosecution, proceeding, right, fine or penalty instituted, created, given, secured or accrued under any ordinance previous to its repeal shall in anywise be affected , released or discharged but may be prosecuted, enjoyed and recovered as fully as if such ordinance or provisions had continued in force, unless it shall be therein otherwise expressly provided.  (1977 Code)

Sec. 1-11.  Repeal not to revive former ordinances.

        When an ordinance repealing a former ordinance, clause or provision shall itself be repealed, such repeal shall not be construed to revive such former ordinance, clause or provision unless it be expressly so provided and such former ordinance, clause or provision is set forth at length.  (1977 Code)

Sec. 1-12.  Severability.

        It is hereby declared to be the intention of the city council that the chapters, sections, paragraphs, sentences, clauses and phrases of this Code are severable, and if any phrase, clause, sentence, paragraph, section, or chapter of this Code shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs, sections, and chapters of this Code since the same would have been enacted by the city council without the incorporation in this Code of any such unconstitutional or invalid phrases, clause, sentence, paragraph or section.  (1977 Code)

Sec. 1-13.  General penalty.

        Whenever in this Code or any other ordinance of the city, or in any rule, regulation, notice or order promulgated by any officer or agency of the city under authority duly vested in him or it, any act is prohibited or is declared to be unlawful or an offense or misdemeanor or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, and no specific penalty is provided for the violation thereof, upon conviction of a violation of any such provision of this Code or of any such ordinance,

rule, regulation, notice or order, the violator shall be punished by a fine not exceeding five hundred dollars or by imprisonment in the city or county jail not exceeding ninety days or by both such fine and imprisonment;

provided, that in any case wherein the penalty for an offense is fixed by a statute of the state the statutory penalty, and no other, shall be imposed for such offense, except that imprisonment may be in the city prison or workhouse instead of the county jail.  (1977 Code)

Sec. 1-14.  Every day a violation.

        Every day any violation of this Code or any other ordinance or any such rule, regulation, notice or order shall continue shall constitute a separate offense.  (1977 Code)

Sec. 1-15.  Responsibility.

        Whenever any act is prohibited by this Code, by an amendment thereof, or by any rule or regulation adopted thereunder, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act.  Whenever any act is prohibited by this Code, an attempt to do the act is likewise prohibited.  (1977 Code)

Sec. 1-16.  Definitions and rules of construction.

        (a)   Construction, general.  All general provisions, terms, phrases  and expressions contained in this Code shall be liberally construed in order that the true intent and meaning of the city council may be fully carried out.  Technical words and phrases having a peculiar and appropriate meaning in law shall be understood according to the technical import. 

        (b)   In the construction of this Code and of all other ordinances of the city, the following definitions shall be observed, unless it shall be otherwise expressly provided in any section or ordinance, or unless inconsistent with the manifest intent of the city council, or unless the context clearly requires otherwise:

        City - The words "the city" or "this city" or "city" shall mean the City of St. James, Missouri.

        City council - The words "city council" shall mean the City Council of St. James, Missouri.

        Computation of time - In computing any period of time prescribed or allowed by this Code or by any notice or order issued pursuant thereto, the day of the act, event or default after which the designated period of time begins to run is not to be included.  The last day of the period so computed is to be included, unless it is a Sunday or a legal holiday, in which event the period runs until the end of the next day which is neither a Sunday nor a legal holiday.  When the period of time prescribed or allowed is less than seven days, intermediate Sundays and legal holidays shall be excluded in the computation.  A half holiday shall be considered as other days and not as a legal holiday.

        County - The words "the county" or "this county" or "county" shall mean theCounty ofPhelps,Missouri.

        Day - The word "day" shall mean a day of 24 hours, beginning at12 o'clockmidnight.

        Gender - When any subject matter, party or person is described or referred to by words importing the masculine, females as well as males, and associations and bodies corporate as well as individuals, shall be deemed to be included.

        Joint authority  - Words importing joint authority to three or more persons shall be construed as authority to a majority of such persons.

        Keeper; proprietor - The words "keeper" and "proprietor" shall mean and include persons, firms, associations, corporations, clubs, and partnerships, whether acting by themselves or by a representative, servant or agent.

        May - The word "may" is permissive.

        Mayor - The word "mayor" shall mean the mayor ofSt. James,Missouri.

        Month - The word "month" shall mean a calendar month.

        Notice - Whenever notice may be required under the provisions of this Code or other city ordinance, the same shall be served in the following manner:

        (1)   By delivering the notice to the owner personally or by leaving the same at his residence, office or place of business with some person of suitable age and discretion, or

        (2)   By mailing said notice by certified or registered mail to such owner at his last known address, or

        (3)   If the owner is unknown, or may not be notified under the requirements of section (1) or (2), then by posting said notice in some conspicuous place on the premises at least five (5) days before the act or action concerning which the notice is given is to take place.  No person shall interfere with, obstruct, mutilate, conceal, or tear down any official notice or placard posted by any city officer, unless permission is given by said officer.

        The provisions of the preceding section shall not apply to those chapters of this Code wherein there is a separate definition of notice.

        Number - When any subject matter, party or person is described or referred to by words importing the singular number, the plural and separate matters and persons and bodies corporate shall be deemed to be included; and when words importing the plural number are used, the singular shall be deemed to be included.

        Oath - The word "oath" shall be construed to include an affirmation  in all cases in which an affirmation may be substituted for an oath, and in such cases the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed."

        Owner - The word "owner", applied to a building or land, shall include any part owner, joint owner, tenant in common, joint tenant or tenant by the entirety, of the whole or a part of such building or land.

        Person - The word "person" shall include a corporation, firm, partnership, association, organization and any other group acting as a unit as well as individuals.  It shall also include an executor, administrator, trustee, receiver or other representative appointed according to law.  Whenever the word "person" is used in any section of this Code prescribing a penalty or fine, as to partnerships or associations, the word shall include the partners or members thereof, and as to corporations, shall include the officers, agents or members thereof who are responsible for any violation of such section.

        Preceding, following - The words "preceding" and "following" shall mean next before and next after, respectively.

        Property- The word "property" shall include real and tangible and intangible personal property.

        Public way - The words "public way" shall include any street, alley, boulevard, parkway, highway, sidewalk or other public thoroughfare.

        Real property- The terms "real property," "premises," "real estate" or "lands" shall be deemed to be co-extensive with lands, tenements and hereditaments.

        Shall - The word "shall" is mandatory.

        Sidewalk - The word "sidewalk" shall mean that portion of the street between the curb line and the adjacent property line which is intended for the use of pedestrians.

        Signature - Where the written signature of any person is required, the proper handwriting of such person or his mark shall be intended. 

        State - The words "the state" or "this state" or "state" shall mean the State ofMissouri.

        Street - The word "street" shall mean and include any public way, highway, street, avenue, boulevard, parkway, alley or other public thoroughfare, and each of such words shall include all of them.

        Tangible personal property- "Tangible personal property" shall include goods, chattels and all personal property, except intangible personal property.

        Tenant, occupant - The words "tenant" or "occupant," applied to a building or land, shall include any person who occupies the whole or a part of such building or land, whether alone or with others.

        Tense - Except as otherwise specifically provided or indicated by the context, all words used in this Code indicating the present tense shall not be limited to the time of adoption of this Code but shall extend to and include the time of the happening of any act, event, or requirement for which provision is made herein, either as a power, immunity, requirement, or prohibition.

        Writing - The word "writing" and "written" shall include printing, lithographing or any other mode of representing words and letters.

        Year- The word "year" shall mean a calendar year, unless otherwise expressed, and the word "year" shall be equivalent to the words "year of our Lord."  (1977 Code)

ARTICLE II

WARDS AND BOUNDARIES

Sec. 1-22.  Division of city into Wards.

        The City ofSt. James is hereby divided into four Wards, names and bounded as herein provided.  (Ord. 366, §1; Ord. 711, §1)

Sec. 1-23.  First Ward boundaries.

        That Ward one, the North Western section of the city, shall embrace all that portion of the city of St. James which is situated West of Highway 68 North to the Southern side of I-44 Right of Way thence East to Home Drive thence South on Home Drive to St. Francis Ave thence West on St. Francis Ave. to Highway 68 thence South on Highway 68 to James Blvd. thence West on James Blvd. to the city limit.  (Ord. 366, §2; Ord. 711, §2)

Sec. 1-24.  Second Ward boundaries.

        That Ward two, the North Eastern section of the city, shall embrace all that portion of the city of St. James which is situated East of Highway 68 North to the Southern side of I-44 Right of Way thence East to Home Drive thence South on Home Drive to St. Francis Ave. West on St. Francis Ave to Highway 68 thence South on Highway 68 to lames Blvd. thence East on James Blvd. to N. Springfield Road thence North on North Springfield Road to South I-44 Right of Way thence East to the city limit.  (Ord. 366, §3; Ord. 711, §3)

Sec. 1-25.  Third Ward boundaries.

        That Ward three, the South Western section of the city, shall embrace all that portion of the city ofSt. James which is situated South of West James Blvd. to Highway 68 thence West of Highway 68 to the Southern edge of theSt.JamesCemetery property thence West to the Western city limit.  (Ord. 366, §4; Ord. 711, §4)

Sec. 1-26.  Fourth Ward boundaries.

        That Ward four, the South Eastern section of the city, shall embrace all that portion of the city of St. James which is situated South of I-44 right of way beginning at the Eastern City Limit thence West to North Springfield Road thence South on North Springfield Road to East James Blvd. thence West on East James Blvd. to Highway 68 North thence South on Highway 68 to the Southern border of the St. James Cemetery thence to the Western city limit. (Ward four includes all property South of theSt.JamesCemetery to the Southern City limit.)  (Ord. 366, §5; Ord. 711, §5)

ARTICLE III

CITY LIMITS

Sec. 1-32.  Classification of city.

        The City ofSt. James shall be organized as a City of the Third Class, according to §77.010 to §77.620, inclusive, of the Revised Statutes of Missouri for 1969, and all amendments and additions thereto.  (Ord. 356, §1.)  (Approved by voters on April 2, 1974)

Sec. 1-33.  Corporate Limits as of August 4, 1892.

        It is therefore considered and declared by the court that the inhabitants residing on the district of lands embraced within the following limits, to-wit:  Beginning at the Southwest corner of Section 20, Township 38, Range 6 West, in Phelps County, Missouri;  Course South 85 degrees West 230 feet to the Southwest corner of the Town; thence North 36 degrees and 30 minutes West 1460 feet to the Northwest corner of the Town; thence North 53 degrees and 30 minutes East 1185 feet to the section line between Sections 19 and 20; thence North 53 degrees and 30 minutes East 1525 feet to the Northeast corner of the Northwest Quarter of the Southwest Quarter of said Section 20; thence North 53 degrees and 30 minutes East 1295 feet to the Northeast corner of the Town; thence South 36 degrees and 30 minutes East 385 feet; thence South 36 degrees and 30 minutes East 385 feet; thence South 5 degrees East 375 feet to the center of said Section 20; thence South 5 degrees East 1320 feet to the Southeast corner of the Northeast Quarter of the Southwest Quarter of said Section 20; thence South 85 degrees West 600 feet; thence South 5 degrees East 1600 feet to the Southeast corner of the Town; thence South 85 degrees West 1040 feet; thence North 36 degrees and 30 minutes West 380 feet; thence South 85 degrees West 790 feet to the Southwest corner of said Section 20, being the place of beginning, the same being located upon the Northeast Quarter of the Southwest Quarter, and the Southwest Quarter of the Southwest Quarter, and the Northwest Quarter of the Southwest Quarter, and the Southeast Quarter of the Southwest Quarter, and the Southeast Quarter of the Northwest Quarter, all in Section 20; and on the Southeast Quarter of the Southeast Quarter and the Northeast Quarter of the Southeast Quarter of Section 19; and on the Northeast Quarter of the Northwest Quarter of Section 29, all in Township 38, of Range 6 West, in the said County of Phelps and State of Missouri, be and the same is hereby organized and incorporated under the name and style of "The City of St. James" as a City of the Fourth Class, and with all the powers and authority granted them by the State of Missouri, under and by virtue of the provisions of the laws thereof relating to Cities of the Fourth Class; and that a police be established for their local government and for the preservation and regulation of any commons appertaining to said city.  And the court, in order to carry out and effectuate said incorporation, designates and appoints Alex J. Rauch as Mayor, Bland Laughlin, F.C. Laun, A. H. Emory and Adolph Mueller as Aldermen, and Robert McDaniels as Marshal and Collector of said City, who shall hold their office until the general election for such officers, and until their successors are duly elected and qualified as provided by law governing Cities of the Fourth Class.

Sec. 1-34.  Annexation by election of March 20, 1900.

        The limits of the City of St. James, in the County of Phelps, and State of Missouri, are hereby extended so as to embrace and include all that part of said Phelps County, Missouri, lying within the outboundary lines, with metes and bounds, as shown on Plat record at the Recorder's office of Phelps County, Missouri, entitled "Pace's First Addition, and Bowman's First Addition to the City of St. James, Missouri."  (Ord. 2, §1.)

Sec. 1-35.  Annexation by election of April 7, 1903.

        (a)   That a proposition be submitted to the qualified voters of said city to extend the corporate limits of said City of St. James, Missouri, at the coming election to be held in said city on the 7th day of April, 1903, as follows, to-wit:  (Ord. 3, §1.)

Sec. 1-36.  Annexation by election of April 4, 1905.

        (a)   That we submit to the consideration of the legal voters of the City of St. James, at the annual city election, to be held on Tuesday, April 4, 1905, a proposition to add to the corporate limits of the City of St. James all that part and parcel of land described below:  (Ord. 4, §1.)

        (b)   Commencing at the Northwest corner of Bowman Street, where it intersects with Jefferson Street; thence running in an easterly direction along the North line of Bowman Street about 990 feet to the North corner of Wishon Street; thence along the East line of said Wishon Street in a northerly direction 170 feet to the Northeast corner where Wishon street intersects with the alley North of Bowman Street; thence in a westerly direction along the North side of said alley about 960 feet to the intersection of the Jefferson road; thence in a southerly direction about 170 feet to the  place of beginning, and further described as the South half of Blocks Nos. 47 and 48 in Bowman's Second Addition to St. James, Missouri.  (Ord. 4, §2.)

        That at the regular city election to be held on the 6th day of April, 1920, there be submitted to the qualified voters of the City of St. James, a proposition to change the corporate limits of said city and fix the same so as to extend the limits of said city over territory adjacent thereto, as follows:  Beginning at a point that is 224.6 feet East of the NW. corner of the NW1/4 NE1/4 Section 19, Township 38 N. Range 6 W. running thence East on the North line of said NW1/4 NE1/4 Section 19, a distance of 1690 feet to an Iron Pin, thence S. 22 degrees, 25 minutes E. along the West side of Jefferson Road a distance of 1445 feet to an Iron Pin, thence S. 58 degrees 30 minutes W. on the North line of Marcella Street a distance of 334 feet, thence S. 22 degrees 25 minutes E. on the West line of a street, a distance of 240 feet, thence S. 58 degrees 30 minutes W. on the North line of an alley a distance of 330 feet, thence S. 31 degrees 10 minutes E. along the West line of Meramec Street, a distance of 1000 feet, thence S. 58 degrees 30 minutes W. along the North line of an alley a distance of 440 feet, thence N. 31 degrees 10 minutes W. along the West line of Bourbeuse Street extended, a distance of 3545 feet to the point of beginning.  (Ord. 6, §1.)

Sec. 1-40.  Annexation by election of August 26, 1947.

        Whereupon the Board of Aldermen of the City of St. James, Missouri does hereby declare that the limits of the City of St. James, Missouri were and are extended so as to embrace and include all that part of the territory lying adjacent to saidCity of St. James,Missouri and described as follows, to-wit:

        Beginning at a point 568 feet East of the Northwest corner of the NE 1/4 of the NE 1/4 of Section 19, Township 38 North, Range 6 West of the 5th P.M. of Missouri, said point being at the intersection of the West right-of-way line of Jefferson Road and the Centerline of Parker Lane and also being the Northeast corner of the present City Limits as heretofore established by Ordinance; thence East along the North line of said Section 19 and the Centerline of Lawrence Street to the Northeast corner of said Section 19; thence continuing East along the North line of Section 20, Township 38 North, Range 6 West and the Centerline of Lawrence Street a distance of 521.5 feet; thence South 32 degrees East a distance of 1540 feet to the Southeast corner of the NW 1/4 of the NW/14 of said Section 20; thence South along the East line of the SW 1/4 of the NW 1/4 of said Section 20, Township 38 North, Range 6 West a distance of 200 feet, more or less, to a point on the present City Limits line as heretofore established by Ordinance.  (Ord. 116, §2.)

Sec. 1-41.  Annexation by election of April 4, 1950.

        The Corporate Limits of the City of St. James, Missouri, are hereby extended so as to embrace and include all that part of the territory lying adjacent to the said city and within outboundary lines designated and described as follows, to-wit:

        FIRST:  A fractional part of the Southwest Quarter (SW1/4)* of the Northeast Quarter (NE1/4)*, and a fractional part of the Northwest Quarter (NW 1/4)* of the Southeast Quarter (SE1/4)* all in Section Nineteen (19), Township Thirty-eight (38) North, Range Six (6) West, and more particularly described as follows:  Beginning at a point on the present City Limits of the City of St. James, Missouri, at the intersection of the North line of said Southwest Quarter (SW 1/4)* of the Northeast Quarter (NE 1/4)* of said Section Nineteen (19); running thence West along the North line of said Southwest Quarter (SW 1/4) of the Northeast Quarter (NE 1/4) to a point at the Northwest corner of what is now known as the Emil Stricker tract or edition, said point being 410 feet West of the Northeast corner of the Southwest Quarter (SW 1/4) of the Northeast Quarter (NE 1/4) of said Section Nineteen (19); thence South along the West line of said Stricker tract or edition and parallel to the East line of the Southwest Quarter (SW 1/4) of the Northeast Quarter (NE 1/4) and the Northwest Quarter (NW 1/4) of the Southeast Quarter (SE 1/4) of said Section Nineteen (19) to a point on the present City Limit line, said point being 410 feet West of the East line of the Northwest Quarter (NW 1/4) of the Southeast Quarter (SE 1/4) of said Section Nineteen (19) and 300 feet North of and perpendicular to the North right-of-way line of U. Highway 66 as now laid out and being the terminus point of said extension.  It is the intention of this ordinance to embrace all of that part of said Stricker tract or edition not now lying within the City Limits of St. James, Missouri.

        SECOND:  Also a fractional part of the Southwest Quarter (SW1/4) of the Southeast Quarter (SE 1/4) and a fractional part of South half (S1/2) of Lot One (1) of the Southwest Quarter (SW1/4) of Section Nineteen (19), Township Thirty-eight (38) North, Range Six (6) West of the 5th P.M. of Missouri; and more particularly described as beginning at a point on the present City Limits line at the intersection of the West line of Elm Street in the City of St. James, Missouri, and the South right-of-way line of the St. Louis and San Francisco Railroad, said point being at Northeast corner of Stimpson's* Subdivision to the City of St. James, Missouri, as recorded in Phelps County Records dated September 18, 1925; thence along a curve to the left of the South right-of-way line of said St. Louis and San Francisco Railroad to the intersection of the Section line of said Section Nineteen (19); thence East along the South line of said Stimpson's* Subdivision and the South line of said Section Nineteen (19) to a point on the present City Limits line, said point being the Southeast corner of said Stimpson's Subdivision and the terminus point of said extension.  It is the intention of this Ordinance to embrace all of Stimpson's* subdivision as it appears of record in the Recorder's office of Phelps County, within the City Limits of the City of St. James, Missouri.  (Ord. 131, §1.)

EXTENSION NO. 2

        Beginning at a point on the present City Limits line at the Northeast corner of what is commonly known asCityBallPark; thence North to the present City Limits line.

EXTENSION NO. 3

        Beginning at a point on the present City Limits line where the North line of Boisselliers Heights Subdivision intersects the present City Limits line; thence East along the North line of said Boisselliers Heights Subdivision extended to the East Quarter Section Line of the Southwest Quarter of the Southeast Quarter of Section Twenty (20) extended; thence North to the South line of Section Twenty (20), Township Thirty-eight (38), Range Six (6) West; thence North Six hundred sixty-nine (669) feet; thence Northwesterly a distance of six hundred sixty-five (665) feet; thence South four hundred eighty-three (483) feet; thence West to the present City Limits line.

EXTENSION NO. 4

        Beginning at a point on the present City Limits line four hundred twenty (420) feet East of the East right-of-way line of Missouri State Highway 68 in Section Twenty-nine (29), Township Thirty-eight (38), Range Six (6) West; thence South to the center line of said Section Twenty-nine (29); thence West along said center section line to a point two hundred fifty (250) feet West of the West right-of-way line of Missouri State Highway 68; thence North to the present City Limits line.  (Ord. 177, §1.)

        At the public hearing, the city council heard evidence concerning the proposed annexation.  It is hereby determined by the city council of the City ofSt. James that the city has the ability to furnish normal municipal services of said city to said unincorporated areas within a reasonable time.

        At the public hearing, the city council heard evidence concerning the proposed annexation.  It is hereby determined by the city council of the City ofSt. James that the city has the ability to furnish normal municipal services of said city to said unincorporated areas within a reasonable time.

        Also known as all of Lots 1 through 32 inclusive of ROSEMARY HEIGHTS ESTATES,  according to plat of R. L. Elgin and Associates, Inc., dated November 30, 1983, and approved by the city council on December 5, 1983, including dedication of all streets, and utility easements.

Sec. 1-49.  Annexation by petition - December 7, 1987.

        Whereas, no evidence was voiced at a public hearing in regard to the annexation, to the City ofSt. James, of the following described property:

All that part of the East Half (E1/2) of the Southeast Quarter (SE1/4) of section seventeen (17) that lies South of Interstate 44 all in Township Thirty Eight (38) North Range six (6) West of the 5th P.M. in Phelps County Missouri.

Be it therefore resolved that corporate limits ofSt. James,Missouribe hereby extended so as to include the above described property.  (Ord. 473.)

Sec. 1-50.  Annexation by petition - July 5, 1988.

        Whereas, a written request for its annexation was submitted to the city council by Lilburn Mash, and

        Whereas, no evidence was voiced at a public hearing in regard to the annexation to the City ofSt. Jamesof the following described area:

Lots 1, 2 and one half of 3 ofBoisselierHeightsand a tract 200 feet long (north and south) and 275 feet wide (east and west) adjoining theBoisselierHeightssouth line.

Be it therefore ordained that the corporate limits ofSt. James,Missouri, be hereby extended so as to include the above described property.  (Ord. 480.)

Sec. 1-51.  Annexation of land purchased for Industrial Development - February 6, 1989.

        The City has purchased this area for Industrial Development, and:

        No protest was voiced at a public hearing in regard to the annexation, described as follows:

PARCEL # 1 (1985):  All of the part of the Southwest Quarter (SW1/4) of the Southwest Quarter (SW1/4) that lies North of Old Highway #66 city route, all in Section Sixteen (16) in Township Thirty-eight (38) North of Range Six (6) West of the 5th P.M. in Phelps County, Missouri.

PARCEL # 2 (1987):  All the part of the East half (E1/2) of the Southeast Quarter (SE1/4) of section Seventeen (17) that lies South of Interstate Highway I-44 all in Township Thirty-eight (38) North of Range Six (6) West of the 5th P.M. in Phelps County, Missouri. 

        Be it therefore ordained that the corporate limits ofSt. James,Missouri, be hereby extended to include the above described properties in the city limits.  (Ord. 488)

Sec. 1-52.  Annexation of two (2) acres of land in Section 20, Township 38 N, Range 6 W, bordering on Holly Lane in the Burning Bush Subdivision - November 6, 1989.

        WHEREAS; Fred Schafer, proprietor of two (2) acres of land in Section 20, Township 38 N, Range 6 W, bordering on Holly Lane in the Burning Bush Subdivision, has requested annexation to the city, and

        WHEREAS; the extension of these limits benefits the city in the sale of all utilities and the acquisition of additional property taxes, and

        WHEREAS; his property fronts onHolly Laneat the edge of the present city limits, and

        WHEREAS; He is complying with the county and state health laws in the construction of his home,

        BE IT THEREFORE RESOLVED THAT THE CORPORATE LIMITS OF THE CITY OFST. JAMESBE HEREBY EXTENDED SO AS TO INCLUDE THE ABOVE DESCRIBED PROPERTY.

Sec. 1-53.  Annexation of a tract of land in Section 20, Township 38N, Range 6W, bordering on the east side of Holly Lane and the north side of Highway DD right-of-way - February 1, 1993.

        WHEREAS: Mr. & Mrs. William J. Price have requested the annexation to the city a tract of land bordering on Holly Lane on the East, Highway DD on the South, and bordering on the North with the recent annexation granted to Fred Schaefer, and;

        WHEREAS: The annexation requested borders on the present city limits and would permit the sale of city utilities and the acquisition of city property taxes, and;

        WHEREAS: Mr. & Mrs. William J. Price will comply with the state and county health laws in the construction of their home.

        WHEREAS Charles James has requested the annexation of property as described below to become a part of the City ofSt. James:

        WHEREAS: this lot borders on the present city limits, and;

        WHEREAS: The Planning and Zoning Board has approved its annexation.

        WHEREAS: The Missouri Highway and Transportation Commission has requested the annexation of their property to the City ofSt. James, Description as follows:

The Right of Way of Primary State Highway Route 68,PhelpsCounty, on both sides of the centerline of said highway. The Centerline of Route 68 extends northwesterly from the existing City Limits on an east-west line crossing the centerline of said Route 68 which is the South line of the NE 1/4 of the SE 1/4 of Section 18, Township 38 North, Range 6 West, located at or near Station 184+80, to an east-west line located on the north line of the NW 1/4 of the SE 1/4 of Section 18, Township 36 North, Range 6 West. Said east-west line crosses the centerline of Route 68 at or near Station 169+48.

It being the intention to include the full westerly Right of Way of said highway Route 68 from Station 184+80 as it extends in a northwesterly direction, from the existing city limits, through the NE 1/4 of the SE 1/4 of Section 18, Township 38 North, Range 6 West, to the North line of the NW 1/4 of the SE 1/4 of Section 18, Township 38 North, Range 6 West, at or near said Route 68 Station 169+48.

        WHEREAS: The City Council approves the annexation.

        WHEREAS: The property lies contiguous and compact to the existing corporate limits of the City ofSt. James;

        WHEREAS: The annexation is reasonable and necessary to the proper development of the city, and the city, has the ability to furnish normal municipal services to the area to be annexed within a reasonable time.

Sec. 1-67.  Annexation of right of way of primary state highway Route 68, Phelps County, on both sides of the centerline of said highway.

        WHEREAS:    Public notice was given and a Public Hearing was held prior to the passage of this ordinance and;

        WHEREAS:    The Missouri Highway and Transportation Commission has requested that said real estate be annexed to and be included with the corporate limits of the City of St. James, Missouri, as authorized by the provisions of Section 71.012 RSMo. 1987.  As description below:

The Right of Way of Primary State Highway Route 68,PhelpsCounty, on both sides of the centerline of said highway.  The Centerline of Route 68 extends northwesterly from the existing City Limits on an east-west line crossing the centerline of said Route 68 which is the South line of the SW 1/4 of the NE 1/4 of Section 18, Township 38 North, Range 6 West, located at or near Station 169+48, to an east-west line crossing the centerline of Route 68 at or near Station 164+20.
