Chapter 19

PARKS, BEAUTIFICATION

AND PUBLIC  PROPERTIES

ARTICLE I

MUNICIPAL PARK BOARD

Sec. 19-1.  Board created; membership.

        (a)   Whereas, the City of St. James, Missouri has decided to establish and maintain a public park under Sections 90.500 to 90.570 and as authorized by said Chapter 90*, and in accordance with the provisions of said law, the mayor is authorized to appoint, with the approval of the legislative branch of said city, a board of nine (9) Directors for the same as authorized by Section 90.520; and as authorized by said section of law; and whereas, said City of St. James is a City of the Third-Class and does hereby ordain and direct the creation of a park and recreation as provided by said Chapter and to appoint  a park board by the mayor of said city with the approval of the legislative branch thereof as provided by Section 90.520 of said act and do all things directed and provided in said law above referred to.  (Ord. 169, §1.)

        (b)   By the authority contained in the law above referred to, the mayor hereby appoints, for the approval of the legislative branch of said city, a board of nine (9) directors chosen from the citizens at large with reference to their fitness for such office, and no member so named to said board is a member of the legislative branch of said city, those named as board members, so chosen from the citizens at large of said City of St. James, Missouri.  (Ord. 169, §2.)

Sec. 19-2.  Compliance with statutes.

        Be it further ordained that the said city hereby approves all the provisions of said Chapter 90 of the Revised Statutes of Missouri 1949 and adopts the same as a part of this Ordinance, so far as it may apply.  (Ord. 169, §3.)

Sec. 19-3.  Terms of office.

        The term of office of the directors shall be and shall be established as provided by Section 90.530 of the Revised Statutes of Missouri 1949 and the said park directors so appointed and approved shall further organize and carry on the duties of their office as provided by said Chapter 90.  (Ord. 169, §5.)

ARTICLE II

CITY BALL PARK

WHEREAS: By Ordinance #05-846 an exchange of 6.43 acres, at Nelson A. Hart Community Park, that belonged fee simple to the St. James School District for approximately 6.43 acres, at the football field, that belonged fee simple to the City of St. James was approved.

WHEREAS: This exchange was finalized on December 20th, 2005 by Quit-Claim Deed, Phelps County Recorder # 2005-8923.

WHEREAS: Ordinance # 381 is no longer needed.

THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ST. JAMES, MISSOURI, THAT ORDINANCE #381 SHALL BE REPEALED.

ARTICLE III

NELSON A. HART COMMUNITY PARK

Sec. 19-19.  Creation of city park.

        A new city park, formerly known as the St. James fairgrounds, is hereby created.  Said new city park shall heretofore be known as the "NelsonA.HartCommunityPark" and shall be so dedicated.  (Ord. 427, §1.)

Sec. 19-20.  Jurisdiction.

        The Nelson A. Hart Community Park shall come under the jurisdiction of the St. James Park Board as established under Chapter 19, Article I of the Revised Codes of the City of St. James.*  (Ord. 427, §2.)

Sec. 19-21.  Effective date.

        This ordinance shall be effective from and after the date of passage.  (Ord. 427, §3.)

Sec. 19-22.  Purpose of dedication.

        This bill is proposed at the request of a number of civic organizations in the community to honor an official of the city for the time and effort expended in the development of this new community facility.  (Ord. 427, §4.)

Sec. 19-23.  Repeal of conflicting ordinances.

        All provisions of Chapter 1115, Sections .001 through .099 of the Revised Codes of the City of St. James are hereby repealed from and after this date.*  (Ord. 427, §5.)
